Beta terms of use

1. Provider and scope

The SHAPELINE beta is provided by Wilhelm Dauner, Langemarckstr. 28a, 86368 Gersthofen, Germany (see imprint). SHAPELINE and Dillrich.Official are brands and projects of Wilhelm Dauner. These terms apply to the use of the beta app at getshapeline.com/app. Before your first use, you confirm them in the app; the confirmation is stored with time and version. If the terms change materially, you confirm the new version at your next start.

2. What the beta is

  1. The beta is free of charge and a test version under development. Features may be missing, faulty, change or be removed.
  2. There is no entitlement to any particular availability, to specific features or to a later full version.
  3. I may change, interrupt or end the beta at any time. Where possible, I will announce this by e-mail.

3. Access

  1. Access is opened for confirmed beta reservations, step by step and at my discretion. I will let you know by e-mail when your access is open.
  2. Access is personal and tied to your e-mail address. You log in with a one-time code sent to that address.
  3. You may not pass your access on to anyone else.
  4. If you breach these terms or misuse the app, I may block your access.

4. Important: results are not an approval

  1. SHAPELINE calculates, among other things, volume, buoyancy, centre of gravity, stiffness and loads. These results are approximations based on simplified models and your input. They may be inaccurate or wrong, especially in a beta.
  2. The results do not replace qualified engineering, inspection or load testing. They are not an approval of any board, mast, foil or part for building or riding.
  3. You alone are responsible for the design, choice of materials, construction, strength and safe use of anything you design with SHAPELINE. This also applies to exports such as CNC data, templates, moulds and parts lists: check them before use.
  4. Board and foil sports as well as workshop work (milling, laminating, resins, electrics and batteries) involve risks to health and property. Follow the safety instructions of material and machine manufacturers.

5. Your designs

  1. All rights to your designs remain with you. You may freely use, build, sell and show them.
  2. You allow me to use, free of charge, images of designs you create with SHAPELINE (e.g. screenshots, renderings, exports) and images you send me through the app or by message, in order to present and promote SHAPELINE – for example on the website, on Instagram and other social media channels, in presentations and press material. This includes cropping, resizing or adding text to the material. This is a simple, non-transferable right of use; your own rights remain unaffected.
  3. If you like, I will credit you as the author; just tell me the name or account to use. You can object to this use at any time with effect for the future – an informal e-mail is enough. I will then adjust posts already published as far as reasonably possible.
  4. For images in which people can be recognised, I will always ask for your separate consent before publishing.
  5. Back up important designs regularly by exporting them. Data may be lost in a beta; there is no entitlement to recovery.

6. Feedback

I may use feedback, bug reports and screenshots you send through the app free of charge, without time limit and without attribution to improve SHAPELINE. Please do not send screenshots containing other people's data.

7. What is not allowed

The software may not be copied, redistributed, sold, decompiled or replicated, except where the law expressly permits it. The app may not be queried automatically or disrupted in its operation. You are welcome to share screenshots and videos of your own work with SHAPELINE.

8. Liability

  1. I am liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
  2. As the beta is provided free of charge, liability for slight negligence is otherwise excluded.

9. Ending use

You can leave the beta at any time – in the app via “Leave the beta” or by informal e-mail. This deletes your access, your reservation and your feedback. When the beta or your access ends, your right to use the software ends as well. Rights to your designs are not affected.

10. Changes and final provisions

  1. I may change these terms with effect for the future. I will inform you of material changes by e-mail in advance; if you continue to use the beta afterwards, the new terms apply.
  2. German law applies. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.
  3. If any provision is invalid, the remaining provisions stay valid.
